The following constitutes the terms and conditions under which you may access and use pre-registration resume consultation services (the “Services”) from StandOut Resumes LLC (the "Company") prior to purchasing a product or service. "You" are the person or entity pursuing or accessing the Services. Please closely review these terms and conditions ("Terms") before accessing or acting upon any pre-registration – in other words, pre-purchase – services with the Company, including, but not limited to, preliminary resume reviews and critiques, initial strategy discussions, career guidance, feedback, suggestions, or any other information provided to you while interacting with the Company prior to purchase. If you decide to make a purchase from the Company following the Services, another agreement will be offered to you.

You understand and acknowledge that by accessing the Services, requesting the Services, or submitting any preliminary information requested by the Company, you are agreeing to be bound by these Terms. If you do not accept these Terms in their entirety, you may not access or use the Services.

COMMUNICATION, INFORMATION, AND ELECTRONIC RECORDS

The Company may allow you to upload, post, send, and/or distribute material or content for the purposes of providing the Services or preparing to provide the Services to you, and accordingly, you are subject to the following conditions:

You understand that all documents, information, data, feedback, comments, suggestions, text, presentations, video, artwork, graphics, messages and other materials of any nature (the "Materials") that you send to the Company are your sole responsibility. This means you, and not the Company, are entirely responsible for the Materials you send to the Company. The Company cannot be held responsible for any inappropriate, illegal, illicit, fraudulent, indecent, or copyrighted material that you send to the Company.

You acknowledge and understand that the Company may store and maintain in its electronic records system and/or files any and all communication, information, documents, data, materials, comments, emails, correspondence, messages, text, and so on that occurs as a result of your use, request of, or pursuit of the Services.

RIGHTS AND PRIVACY

You grant the Company the limited license to use your documents, information, material, comments, feedback, and content, which at times may be anonymized or fictionalized or otherwise stripped of personally identifiable information, for use in marketing, communication, analysis, or other relevant Company efforts. Examples of this include use in any articles, blogs, columns, books, and industry-related publications, whether print or electronic.

You acknowledge that the Company uses its best reasonable efforts to preserve your confidentiality and privacy, including your personally identifiable information and the information that you may provide to the Company for the Services. However, you will not hold the Company liable in the event of an unintentional or accidental breach of your privacy or release of this information, whether within the Company’s data management system, email system, third-party payment processor, from a device used by an owner, employee, or a contractor of the Company, or some other source associated to the Company. Also, the Company will not be responsible for consequences or actual, proximate, or consequential damages of any kind in the event of such a breach or release.

INDEMNITY

You agree to indemnify and hold the Company, its ownership, affiliates, officers, agents, partners and employees harmless from any claim or demand as a result of your use of the Services or the data, communication, materials, and information that you send to the Company while accessing or pursuing the Services.

The Company is not responsible for consequences or actual, proximate, or consequential damages of any kind that you may incur from resume reviews, career guidance, comments, suggestions, edits, data or other consultative information provided to you from the Company while accessing the Service. You will indemnify and hold the Company harmless against any claim brought against the Company regarding the career guidance, information, comments, data, edits, and so on that the Company delivers to you while pursuing or accessing the Services.

AMENDMENTS

You understand and agree that the Company might amend or update these Terms or impose new conditions at any time by revising these Terms as published on the Company’s website. Any use of the Services by you after such revision(s) shall be considered consent by you to these changes or amendments.

AUTHORIZATION & CONSENT TO THESE TERMS

You agree that these Terms will be governed by the laws of the Commonwealth of Pennsylvania. In the event of a dispute about this Agreement, you agree to have the case heard in Philadelphia, Pennsylvania, whether in the Court of Common Pleas of Philadelphia County, Pennsylvania, or, if federal courts have jurisdiction, in the Eastern District of Pennsylvania.

By requesting, accessing and/or using the Services, you understand and agree to be bound by the preceding Terms on this page.
